Terms of Service

These Terms of Service ("Terms") govern your access to and use of ctrlcapture, including the ctrlcapture Chrome extension and the ctrlcapture.com website (together, the "Service"). By creating an account or using the Service, you agree to these Terms.
1. Eligibility
You must be at least 13 years old to use the Service, or older if the applicable age of digital consent in your jurisdiction is higher. If you are using the Service on behalf of an organization, you represent that you are authorized to accept these Terms for it.
2. Your content and ownership
You own all intellectual property rights in the recordings, screenshots, audio, text, and other material you capture, upload, or create with the Service ("Customer Data"). We claim no ownership of it.
You grant ctrlcapture a limited, non-exclusive, worldwide, royalty-free license to host, store, back up, transmit, process, and display Customer Data solely to operate and provide the Service to you — and, only for content you choose to make public or share via a share link, to display that content to the people you have shared it with. This license exists only so the Service can function; it ends when you delete the content or your account. We do not use Customer Data to advertise, and we grant no broader rights to ourselves than those described here.
3. Acceptable use
Recording your own screen for personal, professional, or educational purposes is fine. Publicly redistributing copyrighted material you do not own is not. Specifically, you may not use the Service to:
- upload or publicly share content that infringes someone else's copyright or other intellectual property rights;
- post illegal, defamatory, harassing, threatening, or hateful content;
- distribute malware, spyware, or other harmful code;
- record other people where the law requires their consent, without obtaining that consent;
- upload child sexual abuse material (CSAM). We have zero tolerance for CSAM. Any such content will be removed, the account terminated, and the material reported to the National Center for Missing & Exploited Children (NCMEC) as required by law.

4. Enforcement
We may remove or disable access to content, and suspend or terminate accounts, for violations of these Terms or the Acceptable Use Policy. Accounts determined to be repeat infringers under our Copyright Policy will be terminated in appropriate circumstances. Where practical and lawful, we will notify you of the action taken.
5. Disclaimer of warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, error-free, or that content will never be lost. You are responsible for keeping your own copies of anything you cannot afford to lose.
6. Limitation of liability
To the maximum extent permitted by law, ctrlcapture will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, or goodwill, arising out of or related to the Service.
Our total aggregate liability arising out of or related to the Service is limited to [LIABILITY CAP — CONFIRM WITH COUNSEL].
7. Governing law
These Terms are governed by the laws of [GOVERNING LAW STATE — CONFIRM WITH COUNSEL], without regard to its conflict-of-laws rules.
8. Changes to these Terms
We may update these Terms from time to time. If we make material changes, we will notify you by email to the address on your account and by an in-product banner before the changes take effect. Continuing to use the Service after the effective date means you accept the updated Terms.
